These Terms of Service (“Terms”) govern access to and use of www.CPAPStoreUSA.com, including its webpages, customer accounts, online ordering features, content, communications, products, and related services (collectively, the “Site”).

The Site is operated by CPAP Store LLC (“CPAP Store USA®,” “we,” “us,” or “our”). CPAP Store USA® is a brand used in connection with e-commerce operations conducted through the Site.

By creating an account, submitting an order, checking the box accepting these Terms, or otherwise using the Site after receiving appropriate notice, you agree to these Terms and all policies expressly incorporated into them. If you do not agree, do not use the Site or submit an order.

1. Online-Only Operations

CPAPStoreUSA.com operates exclusively as an online retail platform and does not maintain a walk-in retail location. Products are ordered through the Site and delivered to the customer’s designated address.

Physical locations using CPAP Store® branding may be separately owned, operated, or licensed businesses. Their inventory, pricing, services, policies, transactions, and regulatory responsibilities may differ from those of CPAPStoreUSA.com.

Unless expressly stated otherwise, CPAP Store LLC is not responsible for purchases, services, representations, or obligations arising from transactions conducted through independently operated physical locations or separately operated websites. The address listed in these Terms is for administrative and legal correspondence and is not a retail storefront.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or place an order. If you use the Site on behalf of a business, healthcare organization, government entity, employer, caregiver, or another individual, you represent that you have authority to act on that party’s behalf. You agree to provide current, complete, and accurate information.

3. Customer Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account unless you promptly notify us of unauthorized access. We may suspend or terminate an account when reasonably necessary to prevent fraud, protect customers, comply with law, enforce these Terms, or protect the Site and its users.

4. Medical Devices and Prescription Requirements

The Site offers CPAP machines, BiPAP machines, masks, oxygen equipment, respiratory products, replacement supplies, and other products that may be regulated by the United States Food and Drug Administration or other authorities.

Certain products require a valid prescription or other documentation before they can be dispensed or shipped. We may hold or cancel an order when applicable requirements have not been satisfied. Submitting payment does not guarantee that a prescription product will be dispensed. Customers must use medical equipment only as directed by their licensed clinician and the product manufacturer.

5. No Medical Advice

Product descriptions, educational materials, customer-service communications, fitting information, and other Site content are provided for general informational purposes. CPAP Store LLC is an online retailer and does not independently diagnose medical conditions, prescribe treatment, establish pressure settings, or replace advice from a licensed healthcare professional.

Prescription renewal, physician evaluation, home sleep testing, respiratory consultation, or clinical review may be provided by independent licensed professionals or third-party organizations under separate terms. Nothing on the Site creates a physician-patient relationship between a customer and CPAP Store LLC. Do not rely on the Site for emergency care.

6. Products and Availability

All products are subject to availability. Displaying a product does not guarantee that it is in stock or available for immediate shipment. Product images are for identification and illustration. Packaging, labeling, included accessories, colors, software, connectivity, country of manufacture, and other features may change when manufacturers update a product.

We make reasonable efforts to describe products accurately. If a material error is discovered, we may correct the information, contact the customer, cancel the affected order, or offer an appropriate alternative. Products represented as new are unused unless the product page clearly identifies another condition.

7. Third-Party Brands and Independent Retailer Disclosure

Third-party trademarks, product names, photographs, and brand identifiers belong to their respective owners. References to third-party brands are used for product identification, compatibility, comparison, and informational purposes and do not automatically imply endorsement, sponsorship, affiliation, dealership status, or manufacturer authorization.

CPAP Store USA® operates as an independent online retailer unless a product page expressly states otherwise. Manufacturer authorization, warranty eligibility, software access, cellular connectivity, cloud services, repair programs, and technical support may vary by product, manufacturer, country, sales channel, or purchasing source. Any material warranty or product differences known to us will be disclosed on the applicable product page or communicated before fulfillment when reasonably practicable.

8. Orders and Acceptance

An order confirmation acknowledges receipt and does not constitute final acceptance. Orders remain subject to payment authorization, fraud review, inventory availability, prescription verification, shipping restrictions, product eligibility, and acceptance by CPAP Store LLC.

We may lawfully refuse, limit, hold, or cancel an order because of unavailability, pricing or description errors, payment failure, suspected fraud, missing prescription documentation, manufacturer or regulatory restrictions, quantity limitations, safety concerns, or violation of these Terms. If we cancel a prepaid order, we will return the applicable amount to the original payment method.

9. Order Cancellations

Customers may request cancellation before an order enters processing or ships, but cancellation is not guaranteed. Prescription verification, customized orders, special orders, expedited orders, and orders already processed or transferred to a carrier may no longer be cancellable. If cancellation is approved, any eligible refund will be returned to the original payment method.

10. Pricing, Promotions, Taxes, and Errors

Prices, promotions, product availability, and shipping offers may change without notice. Prices displayed on CPAPStoreUSA.com apply only to eligible online transactions through this Site. Independently operated locations and websites may establish different prices and promotions.

Customers are responsible for applicable sales, use, import, customs, and other governmental charges unless expressly included. We may correct typographical, pricing, discount, inventory, or promotional errors. Promotional offers may be subject to expiration dates, exclusions, quantity limits, and geographic restrictions.

11. Payment and Financing

You authorize CPAP Store LLC and its payment processors to charge the payment method submitted for the amount displayed at checkout. You represent that you are authorized to use that payment method. Charges imposed by a customer’s bank, card issuer, or payment provider are the customer’s responsibility.

Installment-payment, healthcare-financing, HSA, FSA, credit, and third-party payment services are governed by the provider’s separate terms and approval requirements. CPAP Store LLC does not control third-party eligibility or financing decisions.

12. Shipping, Delivery, and Inspection

Shipping options, estimates, fees, free-shipping qualifications, cutoff times, signature requirements, and exclusions are described in our Shipping Policy or at checkout. Delivery estimates are not guaranteed unless expressly stated.

An order is considered delivered when the carrier records delivery at the address provided by the customer or releases it to a person authorized to receive it. Customers should promptly inspect deliveries and report missing, incorrect, visibly damaged, or incomplete items within 48 hours. Failure to report an issue within that period may affect our ability to investigate it with the carrier but does not eliminate nonwaivable legal rights.

Customers must provide a complete and accurate delivery address. Additional charges caused by an incorrect, incomplete, refused, or undeliverable address may be the customer’s responsibility to the extent permitted by law.

13. International Orders

International availability varies by product and destination. We may restrict international orders because of manufacturer limitations, export controls, sanctions, prescriptions, carrier rules, customs requirements, or local law.

The customer is responsible for determining whether a product may lawfully be imported, possessed, and used in the destination country and for customs duties, import taxes, brokerage fees, permits, and destination charges not expressly collected at checkout. Warranty coverage, connectivity, software, electrical compatibility, repair service, and replacement options may differ outside the United States.

14. Returns, Refunds, and Hygiene Restrictions

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms. Because respiratory products may contact the face, mouth, nose, breathing circuit, or bodily fluids, certain products may be final sale after opening, including masks, cushions, pillows, tubing, chinstraps, liners, and humidifier chambers.

A return authorization does not guarantee a refund. Returned products may be inspected for eligibility, condition, completeness, serial numbers, and compliance with the Return Policy. Nothing in these Terms limits nonwaivable consumer rights.

15. Warranties and Warranty Claims

Warranty coverage is determined by the written warranty expressly provided on the product page, invoice, warranty document, or manufacturer documentation. Manufacturer warranties, when available, are administered under the manufacturer’s terms and may depend on the product, serial number, sales channel, customer location, country of use, or eligibility requirements.

CPAP Store LLC does not expand, modify, or independently guarantee a manufacturer warranty unless it expressly provides a separate written warranty.

To request warranty assistance, the customer may be required to provide the order number or proof of purchase, product serial number, photographs or video, and a description of the issue. Products must not be altered, opened for unauthorized repair, or returned without instructions or authorization.

16. Insurance, Medicare, and Reimbursement

Unless expressly agreed in writing, CPAPStoreUSA.com operates as a direct-purchase online retailer and does not submit insurance or Medicare claims for customers. A receipt, itemized invoice, or claim-support document does not guarantee reimbursement. Customers must confirm eligibility, coding, network status, documentation, reimbursement limits, and deadlines with their insurer, benefit administrator, Medicare contractor, employer, or plan.

17. Subscriptions and Recurring Orders

Subscriptions and recurring orders are subject to the terms displayed during enrollment. Before enrollment, the Site will disclose the recurring price, billing frequency, shipping terms, discount, cancellation method, and other material conditions. By enrolling, you authorize recurring charges until cancellation under those terms and applicable law.

18. Intellectual Property

The Site and its original content—including text, graphics, layouts, photographs, videos, databases, software, logos, descriptions, and design elements—are owned by or licensed to CPAP Store LLC and protected by law. CPAP Store®, CPAP Store USA®, associated logos, trade dress, and related brand elements are owned by or used under license from their respective rights holder.

You may use the Site only for lawful personal shopping and informational purposes. You may not reproduce, modify, distribute, publish, scrape, sell, license, reverse engineer, or commercially exploit Site content without written authorization, except as permitted by law. This restriction does not prohibit ordinary indexing by legitimate public search engines performed according to our technical instructions.

19. Customer Reviews and Submitted Content

If you submit a review, photograph, question, comment, or other content, you represent that you have the necessary rights and that the submission is accurate and lawful. You grant CPAP Store LLC a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it for Site operation, customer service, advertising, and promotion. We may moderate or remove unlawful, fraudulent, misleading, abusive, irrelevant, or infringing content.

20. Prohibited Conduct

You may not use the Site unlawfully or fraudulently; interfere with Site security or operation; attempt unauthorized access; submit false prescriptions, payments, reviews, or identity information; circumvent purchasing or security controls; introduce malware or automated attacks; impersonate another person; violate another party’s rights; or purchase products for unlawful export, diversion, resale, or use.

21. Privacy and Data Security

Our collection, use, retention, and disclosure of personal information are governed by our Privacy Policy. Online transmission and storage cannot be guaranteed completely secure. Third-party payment, financing, communication, analytics, advertising, telehealth, and shipping providers may process information under their own terms and privacy practices.

22. Accessibility

CPAP Store LLC is committed to improving the accessibility of its online services. If you experience difficulty accessing the Site, contact us for reasonable assistance or an alternative method of obtaining available information. Accessibility is an ongoing effort; references to standards describe our goals and do not guarantee that every feature or third-party integration will satisfy every standard at all times.

23. Third-Party Services and Links

The Site may link to or integrate with payment providers, financing companies, manufacturers, carriers, review platforms, social networks, telehealth providers, and other third parties. Their services are governed by their own terms and policies. A link or integration does not mean that CPAP Store LLC controls or assumes responsibility for the third party.

24. Site Availability

We may modify, suspend, restrict, or discontinue Site features for maintenance, security, legal compliance, product changes, or operational reasons. We do not guarantee uninterrupted or error-free access and are not responsible for interruptions outside our reasonable control.

25. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CPAP STORE LLC DISCLAIMS WARRANTIES RELATING TO SITE OPERATION EXCEPT WHEN A WARRANTY IS EXPRESSLY PROVIDED IN WRITING OR CANNOT LAWFULLY BE DISCLAIMED. PRODUCT WARRANTIES ARE GOVERNED BY SECTION 15. NOTHING IN THESE TERMS DISCLAIMS A WARRANTY, REMEDY, OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE WAIVED.

26. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CPAP STORE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SITE OR A TRANSACTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CPAP STORE LLC’S AGGREGATE LIABILITY ARISING FROM A PRODUCT, ORDER, OR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO CPAP STORE LLC FOR THE PRODUCT, ORDER, OR SERVICE GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

27. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless CPAP Store LLC and its officers, members, employees, contractors, and agents from third-party claims and reasonable expenses resulting from your unlawful use of the Site, material violation of these Terms, fraudulent documentation, violation of another party’s rights, or unlawful export, resale, diversion, or use of a product. This does not require indemnification for CPAP Store LLC’s own negligence, willful misconduct, or violation of law.

28. Informal Dispute Resolution

Before filing a legal proceeding, the party raising a dispute must send written notice describing the issue and requested resolution. The parties will make a good-faith effort to resolve the dispute for 30 days after receipt. This does not prevent emergency injunctive relief, a report to a regulator, an eligible small-claims action, or exercise of a nonwaivable right.

29. Governing Law and Venue

These Terms are governed by Nevada law, without regard to conflict-of-law principles, except where another jurisdiction’s nonwaivable consumer law applies. Subject to nonwaivable rights, proceedings arising from these Terms or a Site transaction must be brought in a state or federal court having jurisdiction in Clark County, Nevada. Each party consents to personal jurisdiction there.

30. Changes to These Terms

We may update these Terms prospectively for legal, regulatory, security, product, or operational reasons. Updated Terms will identify a revised effective date. Material changes apply only after legally sufficient notice. The version accepted when an order is submitted governs that transaction unless law requires otherwise. Continued browsing alone will not retroactively change terms governing a completed purchase.

31. Electronic Communications

You consent to receive transactional communications electronically, including order confirmations, prescription requests, invoices, shipping notices, policy notices, and account communications. Marketing communications are governed by separate consent requirements.

32. Force Majeure

CPAP Store LLC is not responsible for delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disasters, epidemics, war, civil unrest, carrier disruptions, supply shortages, labor disputes, cyber incidents, governmental actions, import restrictions, or utility failures. This does not eliminate obligations imposed by law.

33. Assignment, Severability, and Waiver

You may not assign these Terms without our written consent. CPAP Store LLC may assign them in connection with a merger, acquisition, sale of assets, reorganization, financing, or transfer of the Site or business, subject to law. If a provision is invalid, it will be enforced to the maximum permissible extent and the remainder will continue. Failure to enforce a provision is not a waiver.

34. Entire Agreement and Incorporated Policies

These Terms and the policies expressly incorporated into them constitute the complete agreement governing Site use and online purchases. Incorporated policies include the Privacy Policy, Shipping Policy, Return Policy, Warranty Policy, Medical Disclaimer, Trademark and Product Disclosure Policy, Accessibility Policy, Mobile Terms, Subscription Terms, and product-specific terms disclosed before purchase.

If a product-specific written term conflicts with these general Terms, the more specific term controls for that product or transaction.
